Terms and Conditions - Cycle Tours, Cycle Hire and Other Equipment Hire

Please read this information carefully before submitting your “check availability” details to us.

General
These Terms and Conditions apply between Country Lanes Lake District (abbreviated to CLLD or referred to as We) and the lead person hiring (referred to as You) and/or any other member(s) of your party, and/or any other persons using CLLD equipment. The use of the word “Equipment” refers to all items hired by You the lead person hiring and includes cycles, helmets, locks and/or any other items owned by CLLD. This agreement and the rights of the parties under it shall be governed by English law.
Deposit
Proof of identification may be requested when hiring Equipment, (e.g. a driving license, passport, photo I.D., etc.). We reserve the right not to hire to an individual. A security and/or damage deposit is required when hiring and will take the form of an open credit/debit card voucher, which will be destroyed upon return of the Equipment in a satisfactory condition. You are responsible for any damage and any repair costs will be deducted from the above deposit.

Security
Equipment must be locked to a permanent fixture whenever it is left unattended. The method of securing should involve using the lock through the frame or structure of the Equipment, then to a permanent fixture, (e.g. a cycle rack or solid metal object). Theft of any inadequately secured Equipment will be the responsibility of You. The replacement costs will be deducted from the above deposit.

Returns
Equipment booked and paid for in advance is reserved for You and will be available for collection anytime during opening hours on the first day of hire. All equipment must be returned to the place from which it was issued before closing time, unless otherwise agreed. This time is recorded on the front of the “Equipment Hire Agreement” form. Late returns incur a charge of £5 per cycle. Additional days are charged by the daily hire rate.

Cancellation
In the event of a cancellation of your booked and paid for Equipment, please contact us. We are happy to reschedule the hire date, providing the Equipment is available on such a date. This is valid for 12 months from the original hire date. Alternatively, if We are able to re-hire the Equipment on the original hire date, we can offer you a full refund. We cannot offer refunds under any other circumstances. Exceptions to this policy cannot be made for any other reason. The above paragraph also applies to Equipment returned early. Travel Insurance
We strongly recommend that you obtain Travel Insurance to cover unexpected costs due to illness, accident, lost luggage, trip interruption or cancellation. Overseas residents must obtain insurance cover in their home country.

Helmets
Helmets are provided free of charge and we strongly recommend the use of them at all times. Adults who decline our offer of a free helmet must sign a Helmet Waiver declaration. All person aged 17 or younger MUST wear a helmet whilst cycling (this does not apply to children using child trailers). Our helmets are certified to the EN 1078 safety standard or equivalent.

Safety
Safe cycling is dependant on your alertness and good judgement. Please cycle sensibly, with respect for others and the natural habitat. You are expected to follow the Highway Code – in particular the ‘Extra Rules for Cyclists’. Anyone cycling in a discourteous or unsafe manner will have the Equipment re-possessed with no refund of the hire charge(s).

Cycling can be dangerous and has risks involved. By agreeing to these terms and conditions You declare to be in good health and are not suffering any medical conditions or disability that is likely to adversely affect normal control of the Equipment. You also agree to:
- Not undertake any manoeuvres that are beyond your skills or beyond the design purpose of the Equipment.
- Not ride on pavements or footpaths, unless it is signed telling You may do so.
- Warn pedestrians as you approach them from behind.
- Be courteous to motorists and other road users, especially horses.
- Start braking early in poor weather conditions, such as rain, mud, ice, snow, fog, etc.
- Not cycle after dark, as your cycles are not fitted with lights.
- Control your speed carefully, especially on all down hills or descents and do NOT race.

If You suspect there is a fault with the Equipment, please contact us immediately. We offer a repair or replacement service and we will come to you. Do not attempt to repair the Equipment yourself if You suspect it has a major fault.

CLLD and its employees cannot be held liable for any injury to You, or to any third party, unless it can be proven the Equipment was faulty at the original time of hire. CLLD is covered by third party liability insurance. This does not cover You for personal injury and/or accidents whilst using the Equipment, or any third party, unless it can be proven the Equipment was faulty at the original time of hire.

Cycle Tours – Additional terms and conditions

Making a Tour Reservation
Before requesting payment We will confirm the full details of your Cycle Tour using your preferred method of communication. Upon receipt of payment We will send You a trip confirmation pack containing information about getting to the start, a detailed trip itinerary, interesting facts about the area to which You are travelling and other useful pre-trip information.

Methods of Payment
Your Cycle Tour reservation is not guaranteed until payment has been received. We accept payment by all major credit/debit cards (excluding American Express). For ease of administration, CLLD will automatically debit any final payment due from your credit/debit card 60 days before the trip start date.

Deposits
Short Tours. A deposit of £50 per person is required to guarantee your short break of 3 nights duration or less.

Longer Tours. A minimum deposit of £150 per person is required to guarantee your reservation for a tour of 4 nights or more. Larger deposit amounts may be required on tours of high value. You will be advised of the required deposit amount when the availability of your trip is confirmed.

Payment in Full
All CLLD reservations received within 60 days of trip start date require payment in full.

Cancellations and Refunds
All cancellations are subject to an administration fee of £50 per person. The remainder of your deposit is fully refundable if We receive written notification up to 60 days before trip start date. If We are notified less than 60 days in advance the following cancellation fees will apply:

Exceptions to this policy cannot be made for any reason. If You are unable to come on your holiday due to serious illness, jury service or any other serious reason, your booking can be transferred to another person up to seven days before trip start, providing the replacement person pays a £50 transfer fee.

Changes to the Itinerary
CLLD tour itineraries are well researched and carefully planned but We are constantly striving to enhance the enjoyment of our holidays. As our experience grows and conditions change, We may find improvements to what We have planned and make alterations for everyone's benefit. Sometimes also, We are required to alter an itinerary due to unforeseen circumstances. In these rare cases, CLLD will endeavour to make alternative arrangements while maintaining quality standards and minimising route changes.

Price Guarantees
The prices quoted are guaranteed throughout 2010. All prices are quoted in Pounds Sterling and are payable in that currency.

Accommodation
All our accommodations used include private bath or shower and feature television, tea & coffee-making facilities, hair dryers and other amenities. Our Classic tour lodgings are quite simply amongst the finest accommodation available in the region. There are a limited number of rooms for single occupancy and these normally attract a supplement.

Meals
Bed & breakfast tours include a full English breakfast each day, but do not include any other meals. Our Classic tours are on a half-board basis and included a full English breakfast and evening meal each day.

Quality Equipment Hire
Quality bicycle hire is included on all CLLD cycle tours. If you choose to bring you own cycle the price of your tour will be reduced by £5 per day.

A word about fitness
Our tours have been designed to be enjoyed by people of all fitness levels. However, as with any active holiday, the time to get in shape is before the trip and not during it. We recommend You embark on a programme of regular physical activity in advance of your trip. And please, if you are in doubt about your health or physical ability, let us know so that we may properly advise you on your trip selection.
